Constitution of the Prussian Empire
Preamble
Whereas this Constitution of the Prussian Empire is created to preserve the political and cultural heritage and significance of our traditional government, and to guarantee stability, justice, and rule of law for our people.

Article I.
Powers of the Landtag
1. The Landtag of Prussia is the highest legal authority in the country and supreme law-making body. Acts of the Landtag are considered part of common law of the country. The Landtag may create Acts pertaining to anything, however the Landtag may not create Acts which violate the individual rights and freedoms protected by the Right of the Citizens of Prussia.

2. All Acts of the Landtag are enacted with a majority of fifty percent plus one in the House of Representatives and House of Lords, along with Imperial Confirmation to the Act. Bills from Parliament may originate in the House of Representatives and House of Lords.

3. The whole of the House of Representatives of Parliament may enact a Motion of No Confidence in the government. This requires passage with a majority of fifty percent plus one of the House of Commons only; approval from the House of Lords or Imperial Confirmation is not required. Upon enactment of a Motion of No Confidence, the House of Representatives is automatically dissolved and a new election must be called by the Kaiser within five days or less.

4. The Prime Minister and ministers of the government take office immediately after being appointed. Nobody can hold a position in the House of Lords at the same time as in the House of Representatives unless they are an Prince of the Imperial House.

Article II.
Elections of the Landtag
1. The upper house of the Landtag of Prussia is the House of Lords. The House of Lords is made up of ten peers, appointed by the Kaiser. The purpose of the House of Lords is to scrutinize and review bills from the House of Representatives.

2. The lower house of the Landtag of Prussia is the House of Representatives. The House of Representatives is made up of four hundred fourty three seats, which are allocated based on the election of the House of Representatives. An election for the House of Representatives must always occur every four weeks after the previously election was held.

3. An election for the House of Representatives takes place in two stages. The first stage is registration by political parties to run in the election, which lasts for twenty four hours. Registration requires that political parties must list the name of their party, leader of their party, and deputy leader of their party. The second stage is the voting, which lasts for twenty four hours. In the voting stage, ballots are cast by voting for one political party. Once an election has ended, political parties are allocated seats in the four hundred fourty three members House of Representatives according to the results proportionally. The leader of a party determines the way in which their party’s seats vote on legislation.

4. According to the results of an election, the Kaiser appoints the leader of the majority party in the House of Representatives to the position of Prime Minister. The Monarch appoints the deputy leader of the same party as the Prime Minister to be Deputy Prime Minister. If the results of an election lead to a Hung Landtag in which no party has an absolute majority of seats, the leader of the largest coalition of parties is appointed Prime Minister by the Kaiser. Government ministers are appointed by the Prime Minister.

5. The Prime Minister is the Head of Government of the Prussia. The Prime Minister may resign from the office, forcing a new election to be called within five days or less. The Deputy Prime Minister succeeds the Prime Minister in their office if the Prime Minister is incapacitated or permanently incapable of fulfilling their constitutional role.

6. A political party is barred from running in an election to the House of Representatives if the party holds the following beliefs: Authoritarianism, totalitarianism, anti-democratic, racism, anti-Semitism, homophobia, xenophobia, white-supremacy.

7. Immediately following a parliamentary election, each political party will have a leadership election. Registration and voting will occur in the same manner as a parliamentary election. The candidate who receives the largest number of votes is elected party leader. The two runner up candidates become deputy leaders. The overall seats of the political party are divided up proportionally according to the results of the leadership election among deputy leaders and the party leader.

Article III.
Powers of the Kaiser
1. The Kaiser of the Prussian Empire is the sovereign and Head of State of the country. The Kaiser may grant titles of peerage and royalty to individuals. The Kaiser may dismiss government ministers if they are deemed a threat to the Government. The Kaiser may dismiss the Prime Minister on the advice of the House of Representatives by a Motion of No Confidence.

2. The Kaiser gives Imperial Confirmation to bills which have passed in the House of Representatives and House of Lords, formally making the bills into laws. The Kaiser may refuse to give Imperial Confirmation for only declarations of war, modifications to Imperial Prerogative, modifications to courts created by law, and if the Act contradicts the individual rights and freedoms protected by the Rights of the Citizens of Prussia. The Kaiser issues declarations of war and signs foreign treaties.

3. The Kaiser has the authority to command and deploy the Prussian Military and Police Force.

4. All members of the government, the Landtag, and royal family of the Prussian Empire are required to have the power to create announcements in the role-playing group.

5. The term Imperial Prerogative shall be defined as all powers and authority granted to the monarch by this constitution. These powers and authorities include the following:
  • Giving or refusing to Imperial Assent according to Article III Section
  • Appoint and dismiss members to the House of Lords according to Article II Section 1
  • Appoint and dismiss the Prime Minister according to Article III Section 1
  • Dismiss government ministers according to Article III Section 1
  • Grant titles of peerage and royalty according to Article III Section 1
  • Command the armed forces and police according to Article III Section 3
  • Appoint and dismiss members of the High Court according to Article IV Section 1
  • Grant legal pardon to any group member convicted by a court of law
  • Appoint and dismiss judges of lower courts in the Court System of the Empire

Article IV.
Courts of the Empire
1. The High Court of the Empire is the highest appellate court in the country. Justices of the High Court are appointed and dismissed by the Kaiser on advice of the Prime Minister. Five justices will exist on the High Court.

2. The High Court is the final court in which lower courts appeal to. The High Court may not overturn Acts of the Landtag unless the Act contradicts the Rights of the Citizens of Prussia.

3. In order for a case to be brought to any court in the Empire, a formal complaint must be filed. The complaint is then deliberated by the court. After deliberation, a case will be accepted by the court with at least a simple majority of the members voting in favor. In a trial, a defendant may request to be heard by a jury of five, selected by the highest ranking judge of the court hearing the case.

4. Court procedure in any court trial must abide by the rights and freedoms provided in the Rights of the Citizens of Prussia. If a trial does not follow constitutional procedure, the decision by the court would be invalid. A guilty verdict by the judges of a court or jury is reached when all but one of the judges or jurors vote guilty. If more than one of the judges or jurors does not vote guilty, then the verdict will be not guilty. The sentence of the convicted is determined by the highest ranking judge of the court or presiding judge in a jury trial.

5. The following is the hierarchy of the Court System of the Empire:
  • High Court of the Prussian Empire
  • Court of Appeals of the Prussian Empire
  • Provincial Court of the Prussian Empire
Each Court will now be defined:
  • High Court: Refer to Section 1 of this Article
  • Court of Appeals:- The Court of Appeal deals only with appeals from other lower courts or tribunals. Its decisions are binding on all courts, including itself, apart from the High Court. There will be three judges on the Court of Appeals.
  • Provincial Court: The Provincial Court functions as a criminal and civil court at the basic level. The Provincial Court hears all criminal and civil case. Cases from the Provincial Court may be appealed to higher courts. There will be three judges on the Provincial Court.

6. The crime of Treason is hereby defined as: The act of attempting to overthrow or harm the Imperial Family; attempting to overthrow Parliament, the government, or the Constitution; Releasing classified government information without consent of the government; A member of the military changing allegiances and aiding the enemy in a state of war or emergency.
